My girlfriend former employer is willfully withholding her 1099 forms because of some bad blood. However, 1099's were supposedly supposed to already be filed by January 31, while the payer doesn't have to furnish the form until February 14. Is my girlfriend liable for not filing in time?

What will she be able to do to force her employer's hand to receive the 1099? Will she be penalized for filing now if she gets the form?
