Sorry for the vague title, but the situation is a bit complicated. About two weeks ago I received an unexpected w2 tax form in the mail that reports around $2,000 of paid wages in 2020. The form is from a past employer whose company I left in 2018.
I called their HR department the next day and asked what this is all about. I was told that the company had been audited and was found to be out of compliance with some scheduling laws. The wage reported on the w2 represents the back payment they owed me for making scheduling errors when I worked for them.
The only problem is I never received any payment. I also find it strange that no one reached out to me to let me know that I should be expecting a check in the mail in the first place.
I called back and asked if they would be able to place a stop payment on the check and reissue it, considering it must have been lost in the mail. They told me that their records indicate the check has already been negotiated. I was told that the check was sent out in the mail either Sept. or Oct. 2020 and that the check was negotiated on Dec. 18 2020 (two months later??). I was pretty baffled.
Not only do I have no recollection of ever seeing the check let alone cashing or depositing it, my bank statements confirm that no such transaction took place.
At this point I’ve asked my former employer to send me an image of the negotiated check so I can proceed with a fraud dispute if indeed the check was fraudulently negotiated.
The last information given to me was that their payroll department has been notified and a ticket has been brought up with ADP where they handle their payroll. It’s been about a week since and no check image yet.
I guess my question is: Where do I go from here? If I do receive a check image with an illegitimate endorsement, what are my next steps for disputing it? But if my former employer isn’t able to produce the check image I’ve requested, do they have any proof to back up their claim that I cashed it? And what should I do in that scenario?
