I am a waitress and I make $2.13 an hour plus tips. The kitchen staff makes $12+ an hour. We are supposed to tip out based on our food sales. I’d estimate I tip out ~$40 a week, and I am only part time. Full timers probably tip out closer to $80+. That is around $2,000 a year for me. This is illegal in my state because we make tip wage and they have regular wages, they are not taxed for it as they are given cash, but it counts in our taxes. We got our W-2s back and they are all wacky, and seem to be way more money than we actually earned, because they don’t even include cash tips. Mine says I made over $19,000 this year, which is absolutely not right because I was out of work for 2 months due to illness and surgery, studied abroad for a month in the summer, and only worked 2-3 shifts a week in the fall to focus on my grades. I’d say I made $14,000 max this year including cash tips. We don’t get pay stubs and I can’t access mine because my boss put my info in wrong... I know this all sounds ridiculous but at the end of the day I still like where I work, the staff and hours are good. If I confront my boss, I will probably lose my shifts or job completely. Everyone feels the same but is too nervous to approach her. Is there any way I can approach this without getting her in trouble? It’s a local restaurant and if she got in trouble with the IRS she’d probably close. A decent job otherwise that I get screwed up on taxes with is better than no job.
