I just received my security deposit back and it had a couple of deductions. Here are the facts:
State: Texas
End of lease: 7/31/17
Number of roommates: 4
Security Deposit: $300
Deductions: -$50 ($200 Nest thermostat)
-$62.50 ($250 cleaning)
Total back: $187.50
The landlord claims we cracked the nest thermostat in the apartment and he had to replace it for $200. No one has any recollection of that happening and we were sure the thermostat wasn't damaged before we left. I requested a picture and he sent one, and it does not look like the way we left it.
Are the cleaning expenses legal (and too much, anyways)? We did not damage the place and we cleaned it well before leaving. I do not believe anything was outside the "Normal wear and tear" as defined by state law.
The kicker: The landlord never inspected the unit, nor cleaned it before we moved in. How is he entitled to charge us, without taking the necessary steps prior to our move in?
If I am entitled to getting my money back, what are the steps I should take?
Any answers to these questions would be much appreciated.
