My car was a 2015 RAV4, and got rear ended. The other guy had no insurance, expired tags, and only an ID card (not sure if it's a driver's license at all). I filed a police report, and called my insurance. After a little back and forth and my insurance running the guys plates/ID they confirmed he has no insurance, and my uninsured/underinsured driver policy kicks in. So I save the $500 deductible, and they will fix my car.

My issue is:

  • They let me choose the repair shop, but apparently will only cover a certain amount. I wanted to use Toyota Dealership/Service center to repair with OEM parts. What is the likelihood the cost will be covered?

  • I understand my insurance will cover my deductible/damages. But my car's value is inherently less than a RAV4 with a clean record. Is there any way to recoup the loss of value due to damage?

  • I'm royally pissed off at the guy who hit me for driving a car without insurance/current tags, and honestly want to utilize everything I can to my fullest legal rights. What exactly more can I do aside from utilizing my claim? Is there any legal recourse to make him pay for damages/wasting my time? I know this sounds entitled, but this is my 4th accident and every time I've never been at fault... Just a bunch of idiots rear ending me/hitting and running.
