Hello! My GF's car was recently hit in a parking lot. She is a timid and very safe driver (since getting to into an accident years ago). She was slowly backing out of her spot and after she came to a standstill a man started backing out of his car fast and wasn't looking and starting backing towards her car. She slammed on the horn but he didn't stop and hit into her car from the side. The backdoor on the left is smashed in and there is no noticeable damage to the other driver's car. Police came, my gf reported they were very nice (I wasn't there) and they both gave their statements. The other driver even said to my gf in private before the cop came that he was at fault. My gf doesn't have collision on her insurance and the estimate came to $2500. When she got the police report it said that the other driver said they started backing out at the same time, which my gf refutes, and he didn't hear the horn. And then that due to conflicting stories they can't determine who is at fault. Now my gf is freaking out because she doesn't have the money to pay for that damage and she doesn't want her insurance to rise.
It seems ridiculous to me that if someone backed into your car that they could somehow NOT be at fault. Her car wasn't moving, he hit her on the side. He clearly was not aware of his surroundings and yet the police report did not reflect this. Is there anything that can be done to challenge this or help?
TL;DR my gf got into an accident that wasn't her fault but the police report does not acknowledge that and now she has $2500 in damages.
