My father was a plumber who worked for a local union, he battled cancer for many, many years but eventually passed away in 2002, when I was 7. My mother, the surviving spouse, was eligible to continue the coverage for the dependents (myself and my two older siblings). As each of us turned 26 we would drop off the insurance as we "aged out". I am not 23, and my older brother is 25.
I received a letter in the mail, detailing that a decision had been made to terminate our insurance as my mother re-married in 2016 under the coverage plan document blah blah blah. She was married for 2 months before she suddenly passed away from a heart attack.
I received the letter two days ago and got around to opening it now, as I didn't know how important it was. Usually they just send out invoices for our payments that I keep a surplus credit on. They have also sent me a reimbursement check for the surplus credit. The letter includes a way to appeal, but they aren't required to return with a decision for up to 90 days. It continues to say that if a decision is made after an appeal it is final and the only recourse we have is legal action.
Should I appeal? Is it worth the time and effort? They include information that if I can prove she did not re-marry they would reverse their decision.... A few family photos and a marriage license are working against us on that one.
Can they terminate my coverage with a two week notice? Is that legal?
I am reaching out to the administrative office tomorrow for some answers, any thoughts would be appreciated.
