5 months ago I took a job as a personal assistant for a one person business.

The job was listed online and a couple interviews later I got the job. I started the next week, but was never asked to sign a contract or give any personal information (social security number, ID, etc.).

The job posting was for part-time and remote, but in the interview they wanted three days at the employers house and the rest could be done remotely.

So the next week I started working out of her house 9-5 for three day of the week, then doing work at home for 7-9 hours a day depending on the tasks. All said I was working 40 plus hours a week instead of the part time discussed in the interview.

For the payments, it was easier for them to pay through PayPal, which at the time I didn’t have so they paid me through my girlfriend’s account.

The next few times payments came to me in the form of a check, sometimes through a personal account or other times through a merchant account they had for the business.

After a few months of burning out on the long hours with no lunch breaks I decided to ask to become an employee. They classified me at the time as a 1099 worker because they didn’t want to pay social security, workman comp insurance, etc. They wanted it to be as cheap as possible.

The idea of making me an employee was pondered for a week, then dismissed. They didn’t want to go through the cost of making me an employee, so I said I didn’t want to work the full-time hours without any benefits and I wanted to be treated as an actual Independent Contractor.

Their solution to this was to immediately cap me at 30 hours so I would never hit full-time status.

However, over last two weeks they have off loaded most of what I did to a friend and the employer herself.

I found myself working only 7 hours a week, so I started looking for new jobs.

Yesterday I sent in my resignation after finishing all the projects for the week. My employer never responded to it — instead, I got a lengthy email from the friend who I’ve never really met saying they won’t pay out for this week and the bonus I was suppose to get from last month until I provide them with a W-9. They also said they won’t pay me until my girlfriend also signs a W-9 because payments went to her PayPal, but she’s never done any work/service for them, and all payments were made under “friends and family” on PayPal.

I haven’t responded because I don’t know what to do.

Do I have to provide this information even though I never signed a contract and don’t work for them anymore? Does my girlfriend need to sign? And am I screwed over with taxes?

The state I’m in is Colorado. Thank you for all who read.
