I am set to close on a house tomorrow, the final walk through was today. During the walkthrough I discovered that the new washer and dryer, that were there during showings and the inspection are now missing. They were not specifically written into our sales contract, however, the real estate listing advertised the house as washer and dryer included. The sellers are now claiming since they weren't in the contract they aren't obligated to leave them, and have in fact already sold them. What is their responsibility of what was advertised versus what's in the contract? If I decided to back out of this closing would I be likely to get my escrow back?

Edit: Thanks for the replies. I will take this as a lesson learned. I am working with an agent, she has taken some responsibility and is offering part of her commission towards a washer and dryer. The seller's agent told my agent that they had planned on leaving the washer and dryer, but they sold it in retaliation for us asking for the refrigerator in the contract, something they never even told us was a point of contention.
