Update on my post from a few days ago.
I called Ally Bank again and the representative informed me that my check was deemed a fraudulent check so my account will be terminated.
I asked if there was anything I could do:
- Mail them the check so they can take a look at it (all they had was my mobile deposit photos which could've been blurry or cut-off)
- Have the person who wrote me the check confirm with their bank (Chase) that it was literally a check written from a checkbook issued by Chase
- Have the person who wrote me the check write me a new one
Answer was nope to all of them because "Sir, we have already determined that the check is fraudulent so there's nothing you can do."
Now, there are only two possible explanations 1) Ally made an erroneous determination 2) My friend did indeed issue me a fake check.
Since I did not receive the check from the bank myself, I cannot rule out #2 as a possibility. It's a trusted friend and they did log in and show me their account in person; plus, I have no reason to believe why they would issue me a fake check. I also compared it to my own Chase checks and everything looks exactly the same. But again, I cannot rule out the possibility that it is indeed fake.
My next steps? Ally seems staunchly opposed to continuing a banking relationship with me. (If it is indeed fake, I understand their decision). Am I able to escalate this further if my friend swears it is real and is willing to verify if needed? Would it be bad if I went to a Chase bank myself and asked them to determine if it is real or not?
However, what does this mean for me, an innocent party?
"Knowingly" depositing a fake check sounds like a crime. Are they going to call the police on me after their investigation? Would this permanently scar my Chexsystem (or whatever "credit" system that banks use for checking/savings accounts)? Would it affect me in the future when I sign up for other banks accounts? ANY legal consequences?
