Hi all, So let me just put out a timeline. November 3, 2018: Hired to start full time immediately after graduation. December 17; First day of work, full time January 2: First pay day($380 taken out for taxes) January 16: Second Pay Day and Day of Termination February 1: New website released.
Now for the background: So I was hired out of college to work for this company full time. From the research I found, there was very little evidence of this company besides the fact that it was only 2 years old and the owner had contacted me through linkedIn for the posting, but other than that, there was only their website and that’s it, no listings on indeed or glassdoor.
So I’m working there for a month, paychecks were due the day before but he said he had some “issue” and couldn’t pay us that day. I’m due for work at 9, I live an hour away from the office, and at 8:45, he tells me not to come in today because he’s really busy and in meetings all day. At noon, he sends me an email saying that I’m terminated. Over the next month and a half, I message him multiple times a week asking about my paycheck. At first he said he couldn’t send it until I returned my parking pass, however, I got that back to him in 5 days. Then he said he sent it, so after waiting 10 business days to be safe, I said the check never arrived, can you either cancel it and let me come pick it up or just follow up with it? He told me that there’s camera evidence of the postman picking up the paycheck, mind you they mail out numerous products daily, and that he’s done his part. He then said that if I wish to talk more on this, to deal with his attorney. On February 14, I asked him about my w-2, to which he told me that it wasn’t his issue to deal with. After providing a link to the IRS website, he told me I’m wrong and then just proceeded to ignore me. Finally, the first week of March, I take him to small claims court. The server won’t serve him and this process is being stretched out very very long, mind you I just graduated from college and really need that cash.
It’s tax season and I still never received my W-2, I tried pulling it up online with the IRS and still no luck, so I call the IRS. After 1 hour and 45 minutes on the phone, the IRS tells me that there is no record of me working at this company. I have a paystub that has all my tax info, $380 taken out, and I was also promised and offered in email $45,000 a year salary, but was only making $38,000. I want to do everything I can to come after this company.
When I took him to small claims court, I asked for $1538, which was 80 hours at the first paycheck’s rate. However, due to not receiving that paycheck, I had missed almost all my bills from the month of January and into February. My credit score went from a 705 down to a 438, and my credit cards got maxed out, just to pay for bills and groceries. Meanwhile, this company, only a 5 person company, has just bought 2 new vehicles parked right out front of the building.
I don’t know what to do, I want to ask for more money for damages, and the taxes that he took out but didn’t even submit to the government. But I also want to see to it that this man takes damage to his business or career. I have found out that he had another business that suddenly disappeared and this business emerged with some of the same clients. I have suffered terribly from this, emotionally, physically, fiscally, and I just want to have some advice. I reached out to a couple of lawyers and no one would talk to a small claims court case, sadly.
