Let me try and get these details straight.

When my girlfriend (let's call her S) started community college, she didn't qualify for FAFSA in time, so her mom took out a $3000 student loan in S's name which S knew about, but Mom told her not to worry and that she was going to pay it back. They used that money to pay for that semester of college (which did not cost $3000).

After that semester, S got approved for financial aid and that paid for her college up until this semester. This is where things get dicey.

S did not receive financial aid this semester because FAFSA claimed she was taking too long to get her degree (she switched majors) so she asks Mom for assistance and Mom says she doesn't have any money because she is saving for a wedding. Understandable. S only took one class this semester because that's all she could afford out of her own pocket.

Well S just got a call saying that now she is not a full-time student and has overdue payments on her loan. She went ahead and paid the current payment because she knew about the old $3000 loan (though this is the first time she is being asked for payments) and figured she was helping out Mom by paying the ~$200.

However, afterward she learned that the loan is not $3000, but nearly $10,000, without a cent paid on it, and S hasn't seen a dime of that money.

Obviously, legal action seems to be the answer in these types of predicaments, though there seem to be so many variables here that we don't really know where to start.

TL;DR: Mom took out $10,000 student loan in daughter's name and expects her to pay it.
