Hi Reddit,

I am writing in behalf of a close friend who is facing some serious prison time. He was wondering some questions that I did not know or could not find the answer to on the internet.

He is facing a few felony charges which could be accompanied by a fine (I realize that it might be out of the scope of this sub, but does anyone know how often fines are ordered by the court along with prison time?)

Anyway, the question that he wanted to ask was whether or not the court can order a 401k to be early withdrawn to pay for the court fines or not. Can the court see how much assets he has and how would they know? What happens if he withdraws from the 401k before the sentencing and transfers it to a relative?

I think I read on the webs that if the prisoner can't pay the fines, it'll still accumulate interest while they are in jail and they will have to pay the original fine + the interest. Is this true? Can he claim bankruptcy at this point?
