I purchased an item from a website I didn't know, but appeared to be okay at the time. The emailed receipt showed the proper price of $41, but the Capital One bill showed $57.92. I emailed the merchant with no response, so I disputed the amount with Capital one and they issued a purchase adjustment of $16.92.

No response from the merchant a month later after sending a few emails (Edit: Never receiving the item), and I notice their website is gone. I call Capital One and they state that they can't do anything about a charge that was already disputed.

Am I screwed out of $41? Or is there another way I need to frame this?
