My parents lost their house during the recession. That same year my dad did not file taxes (this is important later). My parents and I moved into the house where we're living in 2009 as renters. I bought the house in 2010 and my parents gave me money every month. I never reported it on taxes as it was not very much. The mortgage was ~$1300 and they were giving $250-$500 (they have an RV and weren't always at the house). I got married and my husband and I re-fied the house so it was in both our names. Our parents are still living with us and paying about the same amount. Here's the issue. Because of my dad not filing taxes they began to garnish his wages about 8 months ago. He figured that was that, they'd just take it until he was paid up. Last Tuesday he received a letter from the IRS that they were levying his funds. They FINALLY went to see a tax lawyer and are trying to get things squared away. My husband and I want to move, but all of their "stuff" is in the basement. They will not be moving with us and we have been asking them to clear everything out. So far they have not, and now this. They can't rent any place, they are kind of stuck. The tax lawyer said that he could try to get the funds if he could prove they absolutely needed them to live. They asked us to write an "eviction" notice stating they needed to remove their "stuff" from the property in order to sell the house. Here's my question. Is this "eviction" going to bite us in the ass since we've never filed them with our taxes? Is there anything we can do to protect ourselves or are we getting nervous for nothing?
