I was fired without cause from my employer earlier this week. I'm planning to negotiate my severance/potentially hire legal counsel, and in the meanwhile, I was planning to follow the conventional wisdom to immediately file for unemployment.

However, in DC at least, on the unemployment website, there is a section that requires you to say whether you are or will collect severance, and, if so, what the amount will be.

I'm not sure what I should list there as I hope I will be getting severance, but not the amount I've been offered (3 weeks), and there is a chance I don't get any severance at all if I choose to pursue legal action (which I'm still considering).

I don't want to put down "yes" pre-emptively and just list the current severance offer, as that (1) may not end up being what happens, and (2) i'm not sure if that harms my negotiating power with my ex-employer if i've just told the government I am receiving the severance they offered.

Does anyone have any experience with this? Should I just say "no"? Or should I hold to file until after I resolve my severance negotiation?
