I worked at a restaurant as a cook and the place closes between 3-5 to prep for dinner. I had been told initially that I can leave during that time and clock out, but the kitchen manager had asked me to help prep things every day, so on single shift days I would stay until 3:30 or 4, and on doubles I would stay through the whole time.
Two pay periods in a row, I worked overtime due to people calling in for the week and therefore picking up the slack. The first overtime check, they tried to illegally only pay overtime after 80 hours, which I quickly corrected, much to their dismay. (The payroll lady claimed she didn't know the federal law???). Now, this final pay period they took ten hours away from my check for the overtime from the previous check, ($123), but also docked my pay an additional 10 hours, ($80). So for 81 hours of work, I was paid $380.
I am in the process of filing a complaint with the DOL but is there anything else I can do to help my case? I have physical time sheets I printed, and all of my pay stubs.
They claim I would sit at the bar and eat without clocking out. Even if that was true, can they just dock my pay like that without letting me know during the shifts that they want me to clock out?
