Apologies if this is the wrong place, but I didn't know who else to ask. So I live in an apartment in California, and my lease it set to expire June 9. My roommates and I thought this meant that once June 9 comes, if we hadn't renewed, we would just pick up and leave, right? Apparently this isn't the case. Someone who works at the complex called us Saturday (May 13) saying that because we had to give 30 days notice, regardless. We promptly did that, but this now means we have to stay an additional 2 days, because we didn't do it in time. I have my doubts about this in and of itself, but it's not even the worse part.
The manager claims that she sent us renewal letters with the new rates, and the rate for month to month is 6K. She says we will be prorated for the 2 additional days at that rate, which adds up to about $400. To give you some background, that rate is absolutely rediculous for our apartment. We had been paying half that. 6k for our apartment would be unheard of, and even the guy we know who works here says that it's unfair and no one would willingly agree to that.
Now it could be worse. The only reason we knew to give 30 days notice is because the guy we know here called us, which is why we're only on the hook for 2 days and $400. He says that others have ended up not finding out until they were movingly out, and they got charged 6k! I feel bad for these people; I don't care so much about the money we have to pay (although it definitely sucks), but I kind of want to contest this somehow because it makes me mad that people are getting taken advantage of. We probably should have known to give 30 days notice, but to be clear there was absolutely no reminder, and no warning we would be paying this rate. After looking at the lease, it does in fact say we "should give 30 days notice," although it never says what happens if we don't.
The guy we know here says the only reason they charge 6k for month to month is to deter people from doing it, and to charge them at that rate if they forget to give 30 days. So my question is, do we have any room to fight against this? I'm going to talk to the manager on Monday, and I want to know if I have any legal leverage. Thanks so much.
