I posted here a week or so ago about finding out my boss was supposed to be offering me the option to contribute to a 401k.
The responses I got were informative. I've been trying to find out more about my situation and what options I have.
What I'm trying to figure out now is whether or not my boss is obligated to make a Qualified Nonelective Contribution (QNEC) to my account for the three years he failed to notify me that I was eligible for the 401k plan.
He doesn't offer matching or profit sharing since I'm a part time employee. But it is a profit sharing 401k plan. Small business, probably fewer than 15 employees. I don't think anyone else signed up for it.
Does anyone know if this would require a QNEC?
I tried posting about this in r/legaladvice but it received no attention.
