My ex-wife and I were divorced about a year ago. We had a car loan in both of our names, although the car was essentially hers. Upon our divorce, our signed and judge-approved divorce decree indicates the following regarding the vehicle:
Wife shall retain any vehicles in her possession, including a [vehicle make/model]. Further, she shall pay all costs, debts, expenses, or obligations existing or arising in connection with the ownership and operation of said vehicles, including but not limited to taxes, insurance, repairs and maintenance, and shall hold Husband harmless, defend, and indemnify Husband from and against any and all indebtedness or liability in connection with the ownership and operating of said vehicles. Husband shall execute all documents necessary to effectuate these transfer. If necessary, Wife shall refinance or otherwise remove husband's name from any loans and/or indebtedness on the above refinanced vehicles, if able.
For the last 12 months, I asked her again and again to get me off the loan, because if she missed a payment, my credit score would be fucked. I was attempting to be cordial, as she kept indicating that she wasn't able to do it at the time because of this or that. And she was making payments on the car, so I didn't make too big of a fuss.
But lo and behold, it finally happened. I received a notice from my credit provider that my credit score had dropped by 49 points in a single day because the car loan lender reported a missed payment. I also received a letter from the lender indicating:
If you pay the amount now due by the last day for payment, you may continue with the contract as though you were not late. If you do not pay by that date, we may exercise our rights under the law.
I contacted my ex-wife immediately and she agreed to simply just sell the car to a used car shop. Within a few days of receiving the letter, the car was sold, the shop bought out the loan, and now the loan is no more.
But now my credit is still fucked.
Do I have any options here? Or am I just screwed because of her incompetence, and my not making a bigger deal out of this sooner?
