A little background: I work for a small company (less than 20 employees) in South Dakota. We all get paid minimum wage or higher. We get tips, but not often. If you need anymore information please let me know.

Our crew recently received a tip from a customer, and we turned it into the office so that we could make sure that everyone who helped on the job got their fair share. Well a few days go by they still don't have it ready for us so we ask one of the office workers what's up and we are told our boss is keeping the tip to pay for a repair that needs to be done on that job.

Is it legal for him to do this? I had been under the impression that tips were the property of those they were given to. We are also insured for these types of damages so I don't understand why he is keeping our tip.
