Hey guys, I had a small incident that I wanted to some advice on.

I was sitting idle in a drive-thru Taco Bell shortly after midnight when I suddenly felt a car slam into the back of mine. I got out and to my surprise the other driver was a guy I went to school with from elementary through high school.

The car has several deep gouges and the paint is scraped in the shape of his car. The tow-hook port cover is also slightly popped out. I have an Audi A8 and repairs can be quite expensive, unfortunately.

He was under the influence and did not have insurance and asked if we could settle it without reporting it. I told him that I wasn't able to do so because of the potential cost. His response was that he wouldn't have the money to pay for it if it's reported (so why should I trust him to pay?). I snapped a few photos of my car and once I stood behind his car to take a picture of his license plate he backed up, almost hit me, and then sped off. The police show up and all of it is reported. I am going to see if it was caught on camera tomorrow.

So my question is for anybody who has been in this situation. Will he be billed for the damages instead of me? Does my insurance cover it (full coverage) and bill him?
