My family has a small business. One of our employees lost a check and we put a STOP payment with our bank on the check and re-issued a new check, that he cashed. Not long after, he found the original check and took it to ACE Express bank and cashed it there, despite knowing that the original check was stopped. ACE Express requested payment from our bank, who refused payment, and ACE Express is now requesting that we pay it because our bank is not honoring it. We have sent them evidence of the STOP payment, including certified mail, but they continue to send letters requesting payment with more and more interest.
Are we liable to make the payment? Are there actions that we should take?
