Long story short, I was a remote employee working at an ad agency. After about 1.5 years, working at this agency, I moved from Oklahoma (where the agency is located) to Washington. I set up a meeting with my boss, and after telling her this, she asked if I wanted to be switched to a 1099 contractor. I politely declined, and then weeks later received an email being told that I was being switched to a 1099 contractor. I asked if this was being done for tax purposes and they confirmed that it was indeed for tax purposes. Despite contractor status, I still accrued PTO like an employee.
Six months later in Nov 2023, my boss suddenly asks for a video chat. She states that she is switching my agreement to an hourly wage rather than a fixed income. She guarantees me 50 hours for December, and then come January stop assigning me work altogether. I had a gut feeling that this was going to happen and I’m just a little bit lost on what I can do and what my rights are. I don’t have time for a lawsuit of any kind and I just simply want an income while I look for a new job… what can I do?
