Hi there! I’m going to be as detailed as possible.
So I purchased couches from a store and the guy that sold it to me said they would deliver it. At the time I asked him if it was actually in their warehouse or stuck out on ships stuck in the harbor (supply chain issue). The seller told me it was in the warehouse. We purchase the couch with cash. The next morning I check some reviews on the business, see that they are not good, and decide I should cancel my order. It’s Les than 24 hours later. I call the store and tell the sales clerk I’d like to cancel my order. She says it’s not a problem and takes my information and says someone will call me back. I ask repeatedly if there will be any issues with canceling and she’s says no because it’s within 24 hours. Later I get a message from the manager saying I can’t get a refund, but I can pick another couches. They don’t have anything else we want. We go back and forth.I still don’t have the couches. I try and contact their corporate office and can’t get through. A number of weeks go by and I call again and the person that answers looks up our order and tells me that the couches are stuck on a ship and they don’t know when it will be in. So at that point I file a claim with my bank. I get an aggressive message from the store manager. A number of weeks go by and then the couches gets delivered. I attempt again to return the couches and they won’t take it. I contact the bank and cancel the claim. The bank then sends me a letter and says they can’t cancel the claim because they already started the process and the store hadn’t provided the required documentation. So we’re given our money back provisionally from the bank. Meanwhile one of the couches breaks. Someone comes to fix it. It breaks again. We stop using it. Get another couch.
Then we get another notice saying that our claim is settled and we can keep the refund. I contact the bank and tell them I still have these couches. They say the claim is closed and so I’ll have to contact the store. I call the store and ask if we can return the couches and the manager says, “oh sorry we haven’t picked it up yet— if you got a refund, we can pick it up.” He says he’ll call me back. He doesn’t. I call again. This time he’s very rude and tells me I didn’t get a refund I got a credit from my bank and the bank is going to have to pay it back to the store. I ask for their corporate number and he says no because they’ll tell me the same thing. I can’t find the number online.
So now we have these couches— the bank has closed this— we haven’t been contacted by the store since my last call 5 weeks ago. What’s our legal responsibility here? Can we just drive the couches over and drop them off? Do I pay them again for these crappy couches and sell them and try and recoup our money…or wait?
