Hi PF,

Let me preface this — I’m frustrated and defeated. Also, PayPal is not involved. All payments were through eBay Managed Payments.

So, on July 22nd, I sold my old iPhone on eBay. Boom, $473 after fees. Thought nothing of it. Didn’t get a complaint or anything in a reasonable amount of time (two weeks), so I haven’t used eBay since.

Today, I noticed a -$547.99 negative credit in my bank account. I called eBay and they said there was a dispute filed on September 27th against my iPhone for “deep scratches and blemishes”. The buyer provided 0 photos, 0 video, no evidence at all besides a two sentence claim. I sold the phone as used and stated it was in a case and tempered glass screen since day 1. This was in the description on the eBay listing. Unfortunately, my personal email and eBay email are not the same (spam), so I didn’t get the dispute notification. In addition, I don’t use the eBay app because I haven’t been purchasing or selling. Also, in addition, eBay spams you with 2-3 notifications per day every day.

So, eBay says they can’t open the case again but they can file an appeal. Also told me to reach out to my bank to file a dispute. Cool. I give them the details and file the dispute.

Call my bank, do the same thing. File a dispute as an “Inquiry” (didn’t find this out until later). They told me it’s basically in eBay’s hands cause it’s a “merchant dispute”. Cool, so I called eBay back.

Second eBay rep says that the dispute was auto declined because of seller protection guidelines. Since I never responded to the initial dispute from the buyer, I cannot appeal. This is eBay’s terms I guess. So… why did you let me appeal? They said that I was allowed to appeal “in error”.

In addition, eBay has now told me the buyer gets to keep the money and my phone… the buyer is not entitled to send the device back…

So, I called my bank again to dispute it. Bank says “the transaction was an ACH transaction. Bank does not have recovery rights to dispute the funds over eBay.” So, basically, go contact eBay.

But eBay just denied my appeal… and didn’t tell me it was auto denied until I called back.

Can someone help me? Does anyone know if there’s anyway I can get a claim filed or someone to hear me out?

I have video evidence of the phone being shipped out in the condition I described literally at the post office (I do this before I ship out every item). I had 12 pictures on eBay clearly depicting the phone and all four corners. Honestly, the phone was treated better than a baby, it really was. I don’t have insurance on my phones and often resell them when I upgrade so it’s in my best interest to keep them immaculate. I really don’t feel like I exaggerated in my eBay description.

My argument is that: 1. I have photo & video evidence (listing + video (https://streamable.com/uouc9f) 2. Used items are expected to have cosmetic wear & tear 3. Most importantly, how can someone dispute over “deep scratches and blemishes” over two months after they received the item and I don’t get to appeal? My appeal is auto denied?

I’m looking for any and all help. Any way to escalate, whether through the bank or eBay. I’m applying for a mortgage and this is going to mess up my cash flows. I’m losing the $547.99 + the value of what the iPhone 11 they get to keep now is; nearly $1,000 in total. The money isn’t anything life changing, but I don’t like being swindled and I honestly feel like I am the victim of fraud/scam on the buyers end. I truly do.
