We closed on our home April 16th and the a/c blew a hole in itself two days after we closed. I had a specialist come check out the issue to find a safety feature was bypassed causing the damage. He claims it may have been done to pass a home inspection due to the sale. He showed me all the evidence of tampering with wires and components. I contacted the realtor who spoke with the closing attorney about any recourse and sadly was hit with the fact I have no possible action against the sellers as during the inspection the system "worked" per the guidelines.
I have a small emergency fund which is not enough to cover the cost of system replacement. The entire system is damaged. I also owe on credit cards and two vehicles. I'm not sure the best way to approach this cost as I don't want to finance the full cost but at the same time I need to pay off the credit cards. If anyone has any advice or recommendations about how to tackle this I'm open to them.
Home owners insurance will not cover the damage.
Edit: I understand it's not recommended but I have a retirement account that I can either take a loan from or cash out and take a hit.
