Three years ago my daughter was delivered by a doctor that we had never met. Her OBGYN was not at the hospital. Her OBGYN didn’t see us for three more days, and it was a simple “Hey, how are things going?” She was apparently on vacation during the delivery, and so she wasn’t available.
We had a follow up with the OBGYN weeks later, and the insurance paid her for that. In fact, dozens of bills were paid by the insurance company on the day of delivery, and the following months.
On the day of the delivery, there is a claim that was paid to the delivering doctor, the hospital, and several other doctors. All paid - none of them ever had an issue.
A year after the delivery, the office sent me a bill for the delivery. They said that the health insurance company reversed their payment. I emailed them multiple times, and they never responded. I left voicemails, and they never responded. I called the health insurance company, and they really couldn’t tell me much.
I ended up calling the office several dozens of times over the years, occasionally speaking to the office manager. I was told several times that it was being handled, and would never go to collections. The last I heard was over a year ago, and it was apparently resolved.
Now being three years later, they’ve added a collection account to my wife’s credit. The insurance company is well outside of their obligation to pay anything, as that expired after one year. And again - every single claim but their one fraudulent claim was paid by the insurance company. Thousands upon thousands were paid, including additional claims to this doctor weeks after the delivery!
They never contacted us in writing about this debt, nor can they explain why we are being billed for a delivery they didn’t perform. What kind of lawyer would I contact for this? Is there anything I can do? I just can’t understand why this is happening! We did everything the right way, and they’re screwing us right before we buy a house. Due to this credit issue, we won’t qualify for a mortgage!
Please assist.
