Hi redditors,
I booked a hotel in New York using booking.com as I plan on visiting there in a couple months. I booked 10 days/9 nights and the total cost is $1480 usd. A month later (and conveniently the same day their last hotel room was booked according to booking.com) I receive an email from them. The email states that there was an error in the cost of my reservation. The actual rate is 317 usd/night, but they apologize and are offering 265 usd/night. It then goes on to say that I need to let them know if I accept by March 31st or they will automatically cancel my reservation free of charge.
Their self-declared official reason: "The discrepancy in the rates has been deemed an obvious error as per the Terms and Conditions of Booking.com."
So I checked the terms, there is a small blurb about Obvious Errors but it makes it seem like its for a situation where a room has been posted for $0 or something, where that is obvious that's a mistake. But it doesn't actually define what an obvious error is. However, the terms do state that the Service Provider (hotel) is responsible for posting the correct rates.
I feel as though the hotel filled their rooms and now noticed the price I booked for and is thinking, we should make more money here, let's tell this person we're charging them more and if they don't agree we'll kick them out and rebook it for more after the transaction was already made.
This feels like extortion. Do I have any actions I can take against theirs?
