Hi all,

I live in NY state.

A distracted driver on my street veered across the line, knocked over a light pole, slammed into my neighbor's car in their driveway, kept going, and then hit mine. All cars involved are totaled. Driver is okay. Cops seem to think that he was going much faster than the 30 mph on my street to do this much damage.

We filed a claim with our insurance company (which happens to be the same company the driver has. Typical.) and were informed by our claims adjuster that the driver's liability is only for a certain amount ($10k, I think?). This is supposedly to cover the damage to the neighbor's car, my car, and the light pole.

They're still trying to figure out who's responsible for the lightpole (the town or the county), and our claims adjuster said that this part will probably take the longest.

The neighbor's car is a 2015 with collision so they'll likely be okay. My car is a 2001, no collision, and is a piece of crap.

I need my car for my job, and I'll need a rental until I can afford to buy another piece of crap car with whatever money I get from the insurance. My insurance will likely go up, and after everything else is paid off, there likely won't be enough to cover my rental for a reasonable amount of time and a new (to me) car.

I've never handled anything like this before and I don't know the first thing about legal issues. It's extremely likely that I'm getting screwed for something I played no part in and the timing couldn't be worse. So...

What are my options in pursuing this further, other than to work with the insurance company?
