So this is about a situation my younger brother (23 yrs) is in right now. I’m on mobile so sorry about lack of formatting. A little back story: he was planning on living in LA, California for work, and paid an application fee and a (refundable)“holding fee”. He did not get approved for that apartment and the company has told him that they are sending him a refund check for the holding fee ($500), but not the application fee.

He has not received a refund check for the holding fee, he has been in contact with them many times and each time they say the check has been sent out “last week” or something similar. It has been about two months now and it’s becoming clear they have no intention of sending him his money back although they are telling him they will.

He has text proof of these conversations, and has been giving them the benefit of the doubt until now. He has a Bank of America checking account that he paid with. What options does he have? Should he take them to small claims court? (He is now living in a different state), should he contact his bank to see if they will do something on his behalf? He is young, working, and broke, so being ripped off like this is a huge blow for him right now.

TL:DR My brother is likely being ripped off by a California rental company for a $500 “holding fee”, what route should he take to get his money back?
