I'm in California. My husband was arrested on Wednesday 9/26/18. He's facing serious charges and might be gone for a while.
1) We're leasing a car that's in his name only. I have my own car that was paid off before we met. I'll be returning the car because I can't afford it. There's a crack in the windshield from a pebble that flew up on the freeway and there's a nail in the tire. There's probably damage under the car from accidentally running over an island when we were leaving a parking lot. He just forgot the island was there because there weren't any trees or anything indicating that there was anything there. Will I be responsible for the repairs since I wasn't a cosigner and it's only in his name?
2) I'll be canceling his credit cards. He has debts from a bank credit card (Bank A) where we also have a joint checking account. Would it be illegal to take our money out and deposit it into an account at a different bank that he doesn't have ties to? I need his money for rent and living expenses but I don't want to get sued by the creditors at the bank. I had my paychecks deposited into another joint checking account at a different bank (Bank B), so I never contributed to Bank A.
3) I make $2,000/mo and my rent is currently $2,200 and that doesn't include PG&E, grocery budgets, and other necessities. We're leasing a duplex and, with the owner's approval, I plan to search for a roommate on Craigslist. I have enough money to cover rent for October and my parents agreed to help with November when my lease is up. I hope to get a roommate before by December to keep living there. The issue is that we have two kids (ages 6 and 4) and I can't afford to live in this area by myself. My parents babysit for free and they will let my kids live with them and I can rent a room somewhere else. They have a 3-bedroom and my sister and adolescent niece live there, so there's really not any room for us but they'll make it work for my kids. Before my husband was arrested, we were on a wait list for low income housing. His mom was going to live with us too. We were approved after a year for an apartment but his mom changed her mind, so they were going to wait for an apartment with fewer rooms to open up. I feel like the wait is going to be another year or more before something opens up. How can I get back up on my feet to keep my kids with me?
4) My 6-year-old has autism, so I was going to apply for social security for her but the application was asking for contact info for people who assessed her, diagnosed her, teachers, therapists, etc. I honestly don't remember her case manager's name for ABA and early intervention. It was 4 years ago. I could really use the SSI but I don't know how to get past the initial application. I plan to apply for welfare and food stamps. Is there anything else that I can do?
Edit: I filed for bankruptcy in June 2012 and I don't have a credit card. Suffice it to say that my credit is shitty.
