Hello All,

I need a quick advise on cancelling a purchase agreement. Basically, the dealership didn't have a specific configuration I wanted. They offered a locate option and promised to have under 300km on the vehicle on delivery. We went ahead and signed the loan paperwork, final price and monthly payments ( as dealership didn't have the vin yet) with a $500 deposit. Fast forward to now, dealership failed to deliver the vehicle on time and it was almost a week delayed, also the vehicle now has almost 700km instead the promised 300km. I tried contacting general manager and spent countless amount of emails going back forth with them as I was out of town but all I've got offered is a few oil changes (no discounts, no extra warranty, nothing, nor do they have any other vehicle that interests me). At this point I would like to cancel the agreement as I do not want to buy a vehicle which has been driven across the province multiple times and has been listed at multiple different dealerships, literally hundreds of miles away from each other. Since I haven't signed any actual bill of sales nor picked up the car yet, from what I read I shouldn't have any problems backing out of the deal, is that correct? Also, from reading online, since the dealership failed to deliver the vehicle on time and failed to disclose the mileage prior to bringing this vehicle, I should be able to get my deposit back ? Today, I will be sending out an official letter to request my deposit back and will be going down to the dealership to talk to them tomorrow. And depending on the outcome I will be filing a complaint to omvic. If anyone has any advice or if I'm not understanding something properly, can you please help with this ? If I cancel the agreement is there any paperwork I need to make sure I get before walking out? Or anything to make sure I come out of this deal clean before I go to another dealership which has what I want in stock. Thanks in advance
