We've been working with a lawyer on our foreclosure and it's finally come to a head and we're trying to work out a modification.

Our attorney is working with the bank on the back end with their attorneys and we have someone ( from the same office but not an attorney) working on the front end trying to do a modification for us. The front end guy came across the fact that all our original loan docs are made out to and signed by my husband as his nickname (example: John Jim Smith, signed as Jimmy Smith) and not his legal name as on his driver's licence. Technically, the person on the docs doesn't exist and the front end guy thinks we can hire a forensics expert to dig and find the bank at fault for being careless and not by the books with giving the loan. In the meantime, our attorney got a trial 3 month modification from the bank's attorneys but with a hitch: we have to sign a document stating we will never go after or sue the bank for any reason PLUS they are not guaranteeing we'll get the modification after the trial.

Our attorney thinks we have a 95% chance of getting the modification but we are uneasy. The main reason being, it's Seterus we're dealing with and they have a reputation of lying and cheating their customers and being difficult and unbending. There are A LOT of complaints against them and class action suits are being discussed. We don't trust they will work with us fairly after the trial period ends. We have a few days to give our attorney an answer. So do we go with the lawyer and stop the sale of the house and hopefully get the modification? Or do we refuse to sign the document and hope the front end guy can either do a modification without the legal doc or get a forensics guy to dig on our behalf (which is a gamble and very expensive) and continue to fight the foreclosure (which is very stressful)?

P.S. We ended up in this mess to begin with because the original bank, Bank of America, refused to work with us at the beginning when we asked for some help temporarily. They told us we have to go into foreclosure to get any help. The rest is history...
