A tornado blew through my neighborhood recently. It was a weak one but it destroyed my fences. On either side of my home there are empty lots. One is being built and is under contract of sale. My understanding is that shared fences are the shared responsibility of the property owners that own it (at least in Texas). The owners being the builder companies.

I just got off of the phone with one of them (the one under construction and sale contract) and they basically told me I am SOL and they won't help fix the fence. I know there is no way that home will close with a destroyed fence so I have some leverage but that could take 6 months before closing time.

I am still waiting to hear from my insurance. Fortunately, I have a good sized emergency fund to cover such events, but I feel like the builders are being dicks here and trying to see if I will pay for it all. What are my options?

There may be HOA rules that may factor in this as well.
