My dad was a rider on my moms life insurance plan with AXA. He was supposed to continue as a rider on his insurance until his 70th birthday. He would have turned 70 on May 31st 2017. He passed away December 11th 2016. When trying to file the claim my mom was told by AXA that he was dropped in November of 2016, one month before his passing. She asked why he was dropped without notification prior to his 70th birthday and was told that November was the annual renewal month of her policy (she got life insurance November 11th 1989) so that is why he was dropped in November. She never received a notice of him being dropped. After this conversation we tried to file a claim online but never heard back and also never got any written notice of the denied claim.
I recently contacted AXA on my moms behalf and they repeated that he was dropped in November so the claim could not be processed. I mentioned that the annual report from November 2016 showed nothing indication that he was dropped. The representative who was reviewing it agreed that he had not been dropped. He said that there was an additional report sent to out in December that showed he was dropped and a notice (that my mom never received) sent out in November. The rep also stated that the info about him being dropped the November closest to his 70th birthday would be in the contract my mom signed. I reviewed the contract and it was not in there. The rep did the same and could not locate it either.
I then let the rep know that if he was supposed to be dropped November 11th closest to his 70th birthday then he should have been dropped in November of 2017. His birthday is the 31st of May and that makes November 11th 2017 closer to his 70th birthday then November 11 2016. The rep agreed.
Instead of approving the claim I was told to write a detailed letter to the claims department and see what happens.
My mom and I typed up a letter but then I thought that maybe we should take it to court. My mom is 63 and was married to my dad for over 30 years. She should not have had to wait this long or have had to jump through hoops. Should we just send the letter and hope for the best or consult with a lawyer?
I live in in Ohio and the life insurance policy is not very large.
