I got into a car accident on June 24th where the other driver ran a stop sign, and hit me. I broke my hand then soon left the hospital, and began the whole car insurance process. Since it was declared a 0-100 (his fault). I began a claim with Geico (the insurance for the other car), the process began taking quite long because of issues regarding the insurance policy of the other driver since he was borrowing his girlfriend's BMW 5 series.
After some time my family reached out to our own insurance company State Farm, which quickly got an estimate of $8,6xx to repair my car. We held back this check for quite sometime until Geico finally did an estimate on my car. The adjuster recommended we just go through our own insurance since the issues they were taking so long. Car repairs began, and shortly after i received an email stating that Geico gave an estimate of $11,xxx thus declaring the car a total loss. They quickly took back the offer and just reimbursed my insurance company the amount they paid instead after finding out the repairs had already begun.
Today i went to a dealership to trade my car in for a new lease, and when they ran my VIN it showed up as a "total loss" causing my jaw to drop. I've already contacted State Farm, whom have said there's nothing they can do because of NY state law. Geico on the other hand will inform me tomorrow of what they can do for the mistake. I've also spoken to the body shop owner whom is working on it. I've spoken to my lawyer as well who has suggested to try and fix this without his help, but sue them if they fail to fix the problem. I've done some research online to find one other guy who had this issue, and resolved it by contacting CarFax (http://ift.tt/2wiQ39h).
I would really love some further assistance, to be quite honest I have no idea if any of this will work and I'm desperate to get out of this car. The car itself is financed ($12,8xx left), and it's value was VERY close to the loan amount for trade in ($12,xxx).... I was getting offers that would give me basically no negative equity. I'm really worried now, and just want to move on to a new car lease before any new issues pop up.
