(TX) Drunk guy hit my new car overnight and fled the scene. Wake up for work in the morning and see the damage. Come to find he's my neighbor, has a history of DUI's and filed a false report with insurance. Just put $1000 into the car, as it was used. Want to take him to small claims!

Do I have a case? Found out he was my neighbor because I followed the trail of wreckage. His insurance company was the same company that I use which is how I know he filed a false report. I assume he was drunk because after I called the police and filed a report, I found out he has a previous DUI arrest. The insurance company will be compensating me for the vehicle (as it was a total loss) however the $700 dollars in tires will never see use, nor will the $300 of maintenance. Any advice is appreciated!
