I recently moved from away from New York City, one month before my lease expired. After back and forth with our realtor, I agreed to use my security deposit to cover the final month (April 2017) of the lease, with the understanding that our apartment would not be available for rental until 5/1.

I started receiving USPS notifications for Amazon shipments today, and quickly realized someone else was shipping packages to my old apartment. I checked Trulia, and confirmed the apartment was advertised as "available immediately" on 3/30 (thanks Google cache). The listing was recently pulled.

It seems the realty company has taken it upon themselves to break our lease. That's fine, but I would like to receive a partial refund of my last month of rent if that's the case.

I expect to get lots of IANAL, but do I have any legal standing here? My understanding is that leases must be mutually terminated in the state of New York, which definitely did not occur in this scenario.
