So. We just sold our home in Arizona. We had agreed to 7k in concessions to cover the cost of the roof and this is what we signed. When the buyer signed, and the paperwork was all done, 5.2k of this was applied and covered their closing costs. The rest, 1.8k rolled back to us, as it exceeded the max concession allowed.

Now our realtor, called us, and asked we write the buyer a check for the 1,800. Our lender said their lender/agent screwed up and should have caught that (like he did with the home we're buying) and applied it elsewhere, and it's our money and we shouldn't just write the check. I find it kind of sketchy that our realtor called us and make it out like it was just some confusing mistake and she doesn't know what happened (20+ years in the industry, you'd think she'd know there's a Max on concessions)

Is this even legal to ask for? A cash out like this?
