I signed up for the gym membership with LA Fitness at Parsippany on May 12, 2018 (Saturday) afternoon. My gym membership is a $29.99 month-to-month plan with $99 Registration ($169 for the first month). While signing up, the sales representative told me about the personal training membership. I was just curious about it and asked further details about it.
She introduced me to Erik who is a personal trainer there. I told him that I would like to try the personal training a couple of months and want a month-on-month plan similar to gym membership. I asked him if there is any cancellation fee for the plan. He explained about the personal training program like benefits, results and asked my health details and goals. He told me that there is a $75 per session + $99 Registration and I can cancel it at any time without any cancellation fee. He asked me how many times I can come to gym in a week. I told him that I have a tight work schedule and I can come a couple of times in a week. He told me that I can get 18 free sessions if I sign up now and you can schedule whenever I want through the LA Fitness mobile app.
So, I just thought of trying it and agreed to sign up. While signing up, he asked me about how many sessions I may need in a week. I told him that once a week, but I cannot guarantee that due to my work schedule. He told me that if I miss a week, I can schedule it any time whenever I want in the same month. After signing up, he asked me when I can come for the first class which is free session. I told him that I can come tomorrow (Sunday) and so he reserved 11 AM – 11:25 AM with Kruz.
After I left to home from the gym, I got a message from my bank that I have been charged with $169 and $399. I checked my bank statement online and my email address. I got an email from LA Fitness for the personal training program membership with the agreement document attached. I read through the document and found that I was enrolled into a 12-month program with $300 monthly payment and $399 for the first month. There is a 50% payment in case I cancel before the 12-month term.
I read the document thoroughly and found that I can cancel the contract within 3 days of signup and I can get a full refund of my money by doing so. So, I went to the gym on the same day and met Erik and told him that I want to cancel the membership immediately and added that this is the program I am looking for since I cannot afford it. He told me that I can cancel only when I relocate to a place more than 25 miles or I have a personal injury due to which I cannot continue the program. I told him that I can cancel my membership within 3 days as mentioned in the contract. He replied me that they cannot cancel the contract on Saturdays and Sundays and asked me to come tomorrow for a free session, and if I don’t like, I can come Monday to cancel my membership.
I asked him for a copy of the contract and he gave it to me. I went home and read the document once again and found that I can cancel the membership on Saturday, but not Sunday. So, I went to the gym again and told the front desk girl him that I want to cancel my personal training membership and want to speak to the manager. She told me that the manager left for the day and asked me to come on Monday. She asked me who was the representative who I signed up. I told her that it is Erik and she replied me that he left for the day and he will be in the gym tomorrow and she will ask him to call me tomorrow. So, I left the gym and decided to go back on Monday for cancelling my membership and waited for his call on Sunday.
I didn’t receive any call from him and so I called the gym. The front desk connected me to Erik and he asked me the reason for cancelling. I told him that I cannot afford the personal training membership and I have a tight work schedule as well. He offered me $40 per session. I said no, I am not interested, and he asked to come to gym Monday. So, I am going to gym today for cancelling my personal training membership.
I just want to know how I can cancel my membership within the 3 days without any hassle. I know that I can send a certified or registered letter with return requested to LA Fitness in California. I will send the letter if they don’t cancel my membership in the club location on Monday. I read in the internet that I can otherwise report it to Better Business Bureau or I can go to small claims court. I just made a terrible mistake and I became a victim for this program. I need help from you guys. I just want to know what my other options to get out of the personal training membership with full refund.
