i messed up big time.
my former SO and i had a joint checking account when we were together years ago (horrible idea in hindsight. we were very young, very dumb and engaged). it's been about 3 years since we split, and were led to believe that my name had simply been removed from the old account. i realize now that that is not how these things work. she kept using the old account, and i opened a new one at the same bank (capital one).
we're still friends, and she contacted me today telling me that $345 had been transferred out of her account. my checking account has been overdrafted for a while now for that same amount. (i'd like to not go into this please.) i checked my account and it appears that the bank used the funds in her checking account to set-off my debts to the bank. she is now in a very rough spot and will fall behind on her payments unless the bank can refund her the money.
obviously my name must still be one the old bank account, so the bank was well within their rights to do this. tomorrow we plan to go to the bank together to try and discuss this issue with a manager. i am in no position to repay any of my debt to the bank now, and she is now facing financial hardship through no fault of my own. i realize that we are likely at the mercy of the bank when it comes to this, and i was wondering if anyone has any advice for navigating through this or if anyone has had a similar experience.
