Some backstory: I transfered to this company from a sister company (both under the same company system, I guess you could call them sister companies). I worked at this new company for 5 months, which had a 3 month probationary period of attendance. Essentially, I was not allowed to exceed "4 attendance points" within my first 3 months. I had called in sick once (1 point), was late by 3 minutes once (1 point), and missed a clock out once (0.25 points) within my first 3 months at this company, which culminated in 2.25 points within the first 3 months. Following this point, I was supposed to receive an evaluation of my performance and an attendance point cap of 7 points, but due to under-staffing of managers, they quote "did not have the time to evaluate me". At 4 months, I still had not received my 3 month evaluation, and at this point accumulated 3.25 points. Due to not receiving an evaluation, I was still beholden to the 4 point cap, which I had not exceeded. My manager then advised I not receive any more points, which I followed. At 5 months, with 3.25 points and still beholden to my pre-3 month evaluation 4 point cap, I was dismissed from employment due to "attendance infractions I had received at a sister company prior to employment at this company". Essentially, they acquired my time clock record from my previous company (I called in sick about 10 times in a year), which my previous manager and department had no problems with (they were pretty laid back), and used that to state I had exceeded my 4 point cap by my record of calling in sick during my 1 year employment at the previous company, and I was fired in June. After 3 months of dispute with the HR team at the new company, they eventually decided my firing had not followed company policy, and the termination was reversed to a voluntary resignation, and I was offered my job back with back wages for the 3 months I was unemployed. What would be the smartest decision financially for me to make? I've been working at a completely different company for about 3 weeks and was never expecting so much as a dime from the company that fired me.
TLDR: Was wrongfully terminated from my last company, HR decided to reverse my termination to voluntary resignation and offer me backwages for the 3 months I was unemployed. Should I count myself lucky that they offered anything or am I missing the bigger picture financially? Has anyone else experienced this type of situation?
