So this is the third time I've had to deal with water issues coming from my upstairs neighbor (UN). First it was a bathroom leak, and water filled up my bathroom ceiling. Apparently the UN isn't good with baths and water leaked out, through the floor and made my ceiling droop like a fat belly on a pig. Maintenance came and fixed that issue.
About a week ago, I wake up at 7 am to find my kitchen being flooded from above. I was able to get all of our small appliances out of the kitchen and into the living room so we only lost a microwave which renter's insurance will cover. It took a few days but maintenance cleaned up the water and carpet and painted over some spots in the apartment where water stained the walls. There is now mold in our hallway closet where water was and noone caught it. I only discovered the mold this weekend so I haven't been able to tell maintenance about it. The story behind this flood was that UN's washing machine was broken and wouldn't stop filling with water once he started a load of laundry. They fixed it and all was ok.
Until this morning, I'm waking up at 5:30 am to my kitchen flooding again, albeit not as bad as the first time, but I still had to move all the small appliances, including the new microwave and there is a very steady stream of water pouring from the light fixture in the kitchen. I went upstairs to the UN apartment to try and wake him (i can hear the water coming from the source onto his floor through the front door of his apartment) but I can't get anyone to answer the door/no one is home, but it is 5:30 in the morning. I called emergency maintenance and am awaiting their rescue but shit if I am not tired of having my apartment filled with the UN's water.
In any case, my apartment has been damaged by water 3 seperate occasions and now mold is growing because we can't catch all the spots where water is dripping in from above. Is there a way to use this as a way to get out of the lease? We were already planning on moving when the lease was up but would jump at the chance to leave now, especially after the house being flooded again.
