My wife has been with this (retail) company for about 5 years and moved up from sales associate to store manager of her own location. She has been a store manager for about a year-year and a half before she was fired. Her position is an hourly position and her district manager would constantly call my wife on her off days and email her work related things without paying her. Lately her staff has been leaving the company because the district manager is not an effective manager and goes behind my wife's back and harasses her staff (but that is a different issue, so I'll get back on topic). So because of my wife's staff leaving and my wife having issues finding replacements for them; her store has been understaffed. My wife has compensated for this by working extra shifts and only getting one day off a week.

Yesterday, my wife had a day off and one of her associates called in sick but could not find anyone to cover their shift. My wife's district manager was covering the store so she could have a day off. On her day off my wife has started silencing her phone cause, again she constantly gets texts and calls and emails from her district manager on her off days; but in emergencies her staff knows how to contact her.

My wife goes into her store today to get ready to open, starts to count her cash drawer and the district manager came in and said something along the lines of, "I watched the cameras yesterday and saw you and some of the staff standing by the registers not doing anything." My wife replied with, "we might have" not knowing which day/time her boss was referring to. Then her boss said she was fired. No explanation, no papers, and they didn't have my wife sign anything. My wife has no write ups or any discipline reports against her. We are both kinda stunned as we didn't see this coming and we don't know we're to go from here.

Would it be worth talking to a lawyer to see if my wife was mistreated by her company?

Edit: we live and work in Texas
